When a company is placed into a formal insolvency process after 1 December 2020, certain HM Revenue and Customs debts are classed as preferential debts. All other preferential debts must be paid in full before HM Revenue and Customs are paid under its preferential status. The HM Revenue and Customs debts which are classified as preferential include; VAT, PAYE, Employee NIC, CIS and student loan deductions. The HM Revenue and Customs debts which are not classified as preferential debts are Corporation Tax and Employer's NIC.
